Terms of Service

These Terms of Service ("Terms") govern your use of the GifLoop mobile application ("App") operated by Ariel Agor d/b/a GifLoop ("we", "us", "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. The Service

GifLoop is a GIF creation and editing app for iOS (iPhone and iPad, iOS 17+). The App enables you to import photos, videos, and camera captures; arrange and edit frames; apply timing, effects, and audio; and export animated GIFs, videos, Live Photos, and frame strips. All processing occurs entirely on your device.

2. Eligibility

GifLoop is rated 4+ and is available to users of all ages. No account creation is required. By using the App, you represent that you have the legal capacity to enter into these Terms (or that a parent or guardian has agreed on your behalf if you are a minor in your jurisdiction).

3. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on iOS devices that you own or control, for personal, non-commercial purposes. This license does not include the right to:

• Modify, reverse engineer, decompile, or disassemble the App or its underlying code, algorithms, or GIF encoding engine
• Create derivative works based on the App
• Sublicense, lease, rent, or lend the App to third parties
• Use the App for any purpose that violates applicable law

4. Your Content

You retain full ownership of all content you create, import, or produce using the App, including photos, videos, GIF animations, audio recordings, and exported files. We claim no ownership, license, or rights over your content. Since all content is processed and stored on your device, we have no access to it.

You represent and warrant that you have the right to use all content you import into the App, including photos, videos, and audio. You are solely responsible for ensuring that your use of imported content does not infringe the intellectual property rights, privacy rights, or other rights of third parties.

5. Subscription & Pricing

• Free tier: Full GIF creation, editing, and export capabilities with basic features. Includes 3 free Pro-quality exports.
• GifLoop Pro: $4.99 USD — one-time in-app purchase. Unlocks onion skinning, jitter & glitch effects, advanced GIF controls (palette, dithering, lossy compression), audio soundtracks, background removal, and all future Pro features.

GifLoop Pro is a one-time purchase, not a subscription. There are no recurring charges. Payment is processed by Apple through the App Store at confirmation of purchase. Prices are in USD and may vary by region based on Apple's pricing tiers. Prices are subject to change; any price changes apply only to future purchases.

6. Refunds

All purchases are processed by Apple. Refund eligibility is determined by Apple's refund policy:

We do not process refunds directly. If you believe you are entitled to a refund, contact Apple through the link above or via the App Store.

7. Trial Exports

GifLoop provides 3 free exports with Pro-quality settings (advanced GIF controls, effects, audio) before requiring the Pro upgrade. The trial counter is stored in your device's Keychain and persists across app reinstalls. The trial counter increments only upon successful export completion. Once exhausted, Pro features require the GifLoop Pro purchase.

8. Acceptable Use

You agree not to:

• Use the App to create, distribute, or share content that is illegal, obscene, defamatory, threatening, or that infringes any third-party rights
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App, its GIF encoder, image processing algorithms, or any other component
• Circumvent, disable, or interfere with any security, licensing, or access-control features of the App, including the trial counter or Pro purchase verification
• Use automated systems, scripts, or bots to interact with the App
• Redistribute, resell, sublicense, or commercially exploit the App or any component thereof
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices in the App
• Use the App in any manner that could damage, disable, overburden, or impair the App's functionality
• Use the App to infringe upon the copyrights, trademarks, trade secrets, or other intellectual property rights of any third party
• Import or use content (photos, videos, audio) to which you do not have the necessary rights or licenses

9. Intellectual Property

The App, including its design, user interface, code, GIF encoding engine, image processing algorithms, Swift packages (GifEncoder, MediaPipeline, EditingEngine), icons, and documentation, is owned by GifLoop and protected by applicable intellectual property laws, including copyright and trade secret laws. All rights not expressly granted in these Terms are reserved.

The GifLoop name, logo, and associated branding are trademarks of GifLoop. You may not use these marks without prior written permission.

10. Open Source & Third-Party Components

GifLoop uses no third-party open source libraries or external dependencies. The App is built entirely with Apple's native frameworks (AVFoundation, CoreImage, CoreGraphics, Photos, ImageIO, PencilKit, StoreKit, UniformTypeIdentifiers, Vision). Apple's frameworks are subject to Apple's software license agreements.

11. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. Without limiting the foregoing, we do not warrant that:

• The App will be uninterrupted, error-free, or free of harmful components
• GIF encoding will produce files of a specific size, quality, or compatibility
• Exported files will be compatible with all platforms, browsers, or messaging services
• On-device processing will complete within any specific timeframe
• The App will function identically across all supported iOS devices
• Frame effects, filters, or audio processing will produce specific visual or auditory results

GIF encoding involves lossy compression, color quantization, and format-specific constraints. Export results may vary based on frame count, resolution, device hardware, available storage, and selected settings. You accept that exported content may differ from the in-app preview.

12. Limitation of Liability

To the maximum extent permitted by applicable law, GifLoop and its owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising from:

• Your use of or inability to use the App
• Loss of content, projects, or exports due to device failure, iOS updates, or App updates
• Any unauthorized access to or alteration of your device-stored data
• Incompatibility of exported files with third-party platforms or services
• Any interruption, suspension, modification, or termination of the App
• Use of content created with the App that infringes third-party rights

Our total aggregate liability for any claim arising from or related to these Terms or the App shall not exceed the amount you paid for GifLoop Pro, or $5 USD, whichever is greater.

13. Indemnification

You agree to indemnify, defend, and hold harmless GifLoop, its owner, officers, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use or misuse of the App
• Your violation of these Terms
• Content you create, import, or distribute using the App
• Your violation of any third-party rights, including intellectual property rights
• Your violation of any applicable law or regulation

14. Data & Content Loss

GifLoop stores all project data locally on your device. We do not provide cloud backup, sync, or recovery services. You are solely responsible for backing up your content. We are not liable for any loss of projects, exports, or creative work due to:

• Device failure, loss, theft, or damage
• iOS updates or device resets
• App updates that modify the data storage format
• Insufficient device storage
• Uninstalling the App (which permanently deletes all App data)

15. App Updates & Modifications

We may release updates to the App from time to time, which may add, modify, or remove features. Updates are distributed through the App Store. We are not obligated to provide updates, and we may discontinue the App at any time. If we discontinue the App, your existing installation will continue to function subject to iOS compatibility, but no further updates or support will be provided.

16. Termination

These Terms are effective until terminated. Your rights under these Terms will terminate automatically if you fail to comply with any provision. Upon termination:

• You must cease all use of the App and delete all copies
• Sections that by their nature should survive termination will survive, including Sections 4, 9, 11, 12, 13, 14, and 19

We may also terminate your license to use the App if required by law, if we discontinue the App, or if continuing to provide the App becomes impractical.

17. Export Compliance

You agree to comply with all applicable export and import control laws and regulations, including U.S. Export Administration Regulations and sanctions programs administered by the U.S. Office of Foreign Assets Control (OFAC). You represent that you are not located in, under the control of, or a national or resident of any country subject to U.S. embargo, and that you are not on any U.S. government restricted party list.

18. Apple-Specific Terms

The following terms apply to your use of the App as downloaded from the Apple App Store:

• These Terms are between you and GifLoop, not Apple. GifLoop, not Apple, is solely responsible for the App and its content.
• Apple has no obligation to provide any maintenance or support services for the App.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). Apple has no other warranty obligation with respect to the App.
• Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, regulatory compliance, or intellectual property infringement.
• In the event of any third-party claim that the App infringes that party's intellectual property rights, GifLoop, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
• Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you.
• You must comply with all applicable third-party terms of agreement when using the App (e.g., your wireless data service agreement).

19. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved in the state or federal courts located in New York County, New York, and you consent to the personal jurisdiction of such courts.

Class Action Waiver

To the maximum extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against GifLoop.

20. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date at the top of this page and, for significant changes, by providing notice through the App Store update description. Continued use of the App after changes constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App.

21. Force Majeure

GifLoop shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, acts of government, pandemic, war, terrorism, power outages, internet or telecommunications failures, cyberattacks, or Apple App Store outages or policy changes.

22. General Provisions

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GifLoop regarding your use of the App and supersede all prior agreements, understandings, and communications relating to the subject matter.

Waiver

The failure of GifLoop to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms without our prior written consent. GifLoop may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.

Survival

Sections 4 (Your Content), 9 (Intellectual Property), 11 (Disclaimer of Warranties), 12 (Limitation of Liability), 13 (Indemnification), 14 (Data & Content Loss), 17 (Export Compliance), 18 (Apple-Specific Terms), 19 (Governing Law), and 22 (General Provisions) survive termination of these Terms.
